Swampland, TIME

"Prepare to Withstand Political Upheaval"

That line in former Justice Department official Kyle Sampson's December 4, 2006, memo to the White House (where a copy went to then-White House Counsel Harriet Miers) pretty much sums up where things stand on the scandal surrounding the mass firing of U.S. Attorneys. The latest documents released by the Administration show that the White House instigated the move, and that the President himself had passed on complaints he had been hearing about individual prosecutors to Atty. Gen. Alberto Gonzales. The deepening involvement of Miers and Gonzales--aides whose service to Bush goes back to their Texas days, and who are known for their unquestioning loyalty--means that the White House is going to have to answer far more detailed questions about the Administration's motives for getting rid of the U.S. attorneys. It also means that Karl Rove--who last week insisted that the whole episode was merely routine--is likely to be spending more time than he likes on Capitol Hill.

I'm also intrigued by another connection: According to a NY Times profile of Sampson today, he was in competition himself for a U.S. Attorney post in Utah. The name of the guy who beat him out for the job might sound familiar. He was Brett Tolman--who, as I reported in Swampland last week, was the person that Arlen Specter fingered as the Justice Department official responsible for giving the Administration its expansive new power to end-run the Senate in appointing U.S. Attorneys. It was done under a provision, little-noticed at the time, that was inserted into legislation reauthorizing the Patriot Act. That provision now appears certain to be undone by Congress.

Karen,

This is a huge story (at this point, I think even Jay would have to agree). Of course, Josh Marshall has had the best in-depth coverage on this (McClatchy also). This morning Josh
has a really good point about the whole "voter fraud" canard here:

http://www.talkingpointsmemo.com/

"The very short version of this story is that Republicans habitually make claims about voter fraud. But the charges are almost invariably bogus. And in most if not every case the claims are little more than stalking horses for voter suppression efforts. That may sound like a blanket charge. But I've reported on and written about this issue at great length. And there's simply no denying the truth of it. So this becomes a critical backdrop to understanding what happened in some of these cases. Why didn't the prosecutors pursue indictments when GOP operatives started yakking about voter fraud? Almost certainly because there just wasn't any evidence for it."

And Devilstower over at Kos has the most succinct and post-on bottom-line conclusion I've read, here:

http://www.dailykos.com/storyonly/2007/3/13/5945/73708

"Tear the story down to its components and you have: Rove looking for a political edge, Bush nodding at Rove's every whim, and Gonzales eagerly twisting the truth to justify whatever Bush puts in front of him. That's not just the story of the purge, it's the script for this whole administration."

James, Los Angeles:

More key grafs from TPM, who has been on this story from day one:

`````
Perhaps as telling, according to the new Times article, Kyle Sampson, Alberto Gonzales's Chief of Staff and the guy who was actually in charge of drawing up the list ... well, he resigned today.
We now know that Gonzales, McNulty and Moschella each lied to Congress. We know that the purge was a plan that began at the White House -- and it was overseen by two of President Bush's closest lieutenants in Washington -- Miers and Gonzales. Sampson is the second resignation. There will certainly be more.
And remember this key point: The 'document dump' is meant to get bad news out of the way fast. But it's always a hedge. It never includes the really bad stuff. And if you're not in deep crisis mode, ya' never do it on a Monday.
``````

Josh has all the links and documents that have become available.

Funny, there is nothing on the Time Inc website about this story. And they wanted to "set the news agenda." tsk.

I do think like FireDogLake was the place to go for the Libby trial, TPM is the place for the attorney firings.

Or I could wait for Jay to break some news here!

Karen Tumulty raises a good point about the Kyle Sampson-Brett Tolman angle. It shows that Sampson maybe wasn't crooked enough to get the US attorney post in Utah. Tolman set the bar at a new level when he got the new, "improved" version of the Patriot act through. When he did that, the Bush cabal knew he was capable of doing ANYTHING they wanted him to. So, he gets the US Attorney post, while Sampson is relegated to a second-tier job helping fire any US Attorney with spine or integrity.

This tells me that Congress needs to take a serious look at all the US attorneys that Bush appointed. What a bunch of career political criminals they must be. And before you shrug that off as too far-fetched, remember, just two weeks ago it would be far-fetched to think that Bush was helping force out US Attorney Generals who wouldn't do the bidding of their local Republican Senators.

By the way, a news organization, if it didn't want to be left in the dust, might start investigating who Bush appointed to the US attorneys posts around the country and what shady dealings they might be involved in. Just in case you're looking for an angle to this story that isn't being covered better by Josh Marshall, Daily Kos, or a half-dozen others.

Teresa:

I'd really like to see Time and the local San Diego papers put pressure on Carol Lam's replacement to make sure the follow up indictments on Duke Cunningham's cronies (Dusty Foggo & Brent Wilkes) are actually carried out instead of conveniently forgotten under a new US AG. My feeling is that there is still a lot of dirt there that leads to more corruption by sitting US Congressmen.

I give Karen credit for keeping up with this. I find it curious that the new Politico web site NEVER mentions this story.

Sperm Donor:

Jay Carney has yet to apologize for labelling those people that suspected that where there was smoke there was fire as conspiracy theorists.

It's bad enough that he didn't get the story. It's even worse that he dismissed it with a "nothing to see here, move along" type of response. It makes him look like a shill and a propagandist rather than a real journalist.

(And no, Karen, I for one will not let Jay live this down, but will bring it up again and again, until he apologizes.)

In case anyone in traditional/corporate media is wondering why blogs and "shrill" sources of news manned by "dirty, stinking, hippies are growing in attracting audiences, and why the people that are part of these growing audiences have such contempt for the corporate media, Jay's response to this story when Josh Marshall first reported it would make a great Exhibit A.

But, on second thought, how about the way the corporate media carried water for the Administration in propagating the Administration's phony WMD claims during the run-up to the war? Wouldn't that make a great Exhibit A?

Or how about the Downing Street memo and how most of the corporate media has ignored it?

Or how about . . . . .?

As that old lefty, Gore Vidal has written, the JOB of the corporate media is to DISTRACT the American people from what is really going on.

Jay Carney...please pick up the white courtesy phone. Jay Carney...please pick up the white courtesy phone.

Elvis Elvisberg:

Thanks for keeping with this story, Karen.

Alberto Gonzalez lied to Congress, right?

It's a sad reflection of the worst of human nature that GOP flacks will find some way to defend the administration on this.

Last week the party line was, "Oh, this stuff happens all the time, it had to do with their failure to prosecute certain cases, it's not like the White House had anything to do with it. Alberto Gonzalez even said so!"

Worse than Watergate, vol. 9.

jill:

This is a scandal that will bring down Gonzales, Rove and possibly Bush. The longer Jay Carney remains silent the more it looks like he is a shill for the Bush Administration. Journalists are agitators. They are supposed to report on those in power. Investigating this scandal doesn't mean you are a liberal, it means you are a journalist. It's too bad Jay's instincts were to give this Administration the benefit of the doubt.

Aaaaand, our very own commenter linda bagged the Time blog page Quote of the Day! Kudos, linda!

Tobias Funke:

The sad thing is, Is anyone really shocked that the Bush Administration did all this? I'm not outraged by their actions or subsequent covering up. I'm just shocked that the MSM is paying attention. Josh Marshall and his crew at TPM deserve a ton of credit, but what gave this story legs is that there is a Democratic Congress, with Democratic Congressional Chairmen who can keep the pressure on the White House. Rove et al can no longer hide behind the Rep Davises and Rep. Specters of the world.

jill:

This scandal grows everyday. Boston.com is reporting that an investigation in Guam involving Abramoff was beginning until Bush had the AUSA in Guam replaced. Guess what happened to the investigation after the replacement was made...the investigation ended, Mission Accomplished! Get on it Jay, this story could have made you a star.

Sean:

More fuel for a fire that never seems to burn anybody. The administration will twist and spin, and congressional inquiries will hem and haw, and it won't change anything.

I'd be interested in reading a story that shines a light on the 30% of the voting Bush die-hards that still believe any part of this administration is worth defending.

And how much longer will the country be held hostage by lame 'Clinton did it' excuses and a constant spin on logic and common sense?

JoyousMN:

Karen added new content to this story that I hadn't seen before. Brett Tolman got a USA's job??? That wasn't on TMP that I saw.

Here in MN we lost our Attorney general too. Heffelfinger resigned on Feb 28 and that fits into the same timeline as all the others. Is that connected in any way to this story?

Sperm Donor:

"It's a sad reflection of the worst of human nature that GOP flacks will find some way to defend the administration on this."

--Well it's what they do. It isn't about right and wrong, following the law or not following the law to them. It is about getting and abusing power, protecting "their side" and their cronies interests, making lots and lots of money, and playing a constant game of CYA doing it. Think of the Mafia. Do you think John Gotti or Sammy Gravano or Al Capone and their underlings would have done anything differently? Well, that's what we have in power in D.C. . . . . a version of the Mafia, only their last names don't all end in vowels, and they operate under a veneer of legitimacy (granted to them, in large part, by the corporate media) because they staff positions in the government. But they are much, much more powerful, just as corrupt, and capable of doing far greater damage.

--What really looks bad, however, is when the media is in on it too. But, why should I be surprised? If anyone remembers the film "The Godfather," the Corleone family also had journalists on its payroll, who's function it was to aid in "perception management."

--"Paging Tim Russert." "Paging Andrea Mitchell." "Paging Judith Miller." "Paging Jay Carney." "Paging (fill in the name of your favorite media whore.)" "The White House is on the line."

Mommy tells me if a work really hard, I can work for Jay Carney at Time

What had happened was.....
Per FoxNoise
_Harriet Miers floated the idea of firing all 93 USAs to start second term fresh
That was rejected by DoJ
_The 8 were fired because of poor job performance.
_NM GOP chair had complained about his USA, but the firing was already in the works.
_GW did mention that he was concerned about lack of attention to voter fraud, but never ordered a specific person fired
_Unknown if Rove contacted anyone at DoJ
_Rove did tell Miers about complaints about NM USA Iglesias
_Sampsom resigned because he failed to inform others in DoJ of all the communications he had with the WH regarding the USAs. Thus the other DoJ official's statements may have been based on incomplete information.

Nothing to see. Jay Carney was right. As Rove says, "A very big attempt by some in the Congress to make a political stink about it."
The WH just wanted prevent illegal aliens (or too many Blacks) from voting.
It's that vast left wing conspiracy aided by MSM.* Only those bad leftie bloggers see bad behavior here. A skilled journalist like Carney knows there's no story.

*except MSM didn't break the story.

Karen T.:

If Jay Carney had a scintilla of integrity, he'd post a statement THIS MORNING that he was wrong about the prosecutor story.

I said "if".

Dead Horse:

I like Carneys. They were the toothless guys who worked the tilt-o-whirls of the county fair.

Jay, maybe the job at the magazine is a little over your head with the prognostication thing not working out so well for you. There will always be the tilt-o-whirl.

Cranky Observer:

Karen T,
Bad timing, eh?

The question I would ask Time to ask itself is: why did the traditional media allow itself to be punked _yet again_ by the Bush Administration and its spin machine? The usual case of "SAOs" were trotted out to tell the traditional media "nothing to see here; move along". Despite that fact that every single instance of this happening for the last 6 years has resulted in an eventual finding that there actually was something being covered up (usually something pretty bad), the traditional media buys the spin and allows Lucy to pull the football away for the 6th year in a row. Why?

Does a senior editor of one of the world's major news magazines really not know that George W Bush _also_ fired all the USAs when he entered office in 2001, as did Ronald Reagan? And that no one complained, because doing so is SOP? So not only is the midyear massacre unprecedented but Bush was /firing his own handpicked USAs/.

Sheesh.

My two cents on this: it still sounds a bit overblown. Don't forget that Clinton fired all the US Attorneys when he came in. A lot of observers said some of the scandals he faced, such as Socksgate, would have been a lot worse had he not been cronies in so many DOJ offices. I'm not agreeing with that view of things, but some who know a lot more than I do (or most of you do) certainly did.

OH-MY-GOD
I thought that Fox was being dense.

I have heard the following
_A lot of observers said some fo the scandals of the Bush administration would have been a lot worse had Bush' people not been cronies with so much of the MSM. I'm not agreeing with that view of things, but some who know a lot more than I do (or Jay Carney knows) certainly think that.

jon hamel:

ATTENTION ALL: The posted comment attributed to Jay Carney is a hoax. If it was real it would not be be placed on the blog as response comment. It would simply be a new blog entry.

Karen, you've been doing a good job following this story, especially considering that moron Jay dropped it so badly (and in such an embarrassing fashion).

However, given all that we know now, I think it's time that TIME and other MSM outlets rediscover their opinion roots. Specifically, given what we know now, I think somebody at TIME (either the mag or Swampland) call for AG Gonzales to resign.

Look, it's nice that you're keeping the readers informed on this story, and it's nice that you've added a bit to it with the Brett Tolman angle. But the obviousness (is that a word?) of this corruption begs for more than just spectating from the gallery.

It's time to get off the fence, and to take a stand.

steve:

What interests me is Carneys lack of instinct in covering this administration.

You'd think after 6 years of covering this admin, Carney would have some sort of radar (some cal it journalistic chops) about this story.

My respect for him is at an all time low.

glasnost:

Speaking as someone absolutely convinced that Alberto Gonzales should resign and that the Republicans have politicized the DoJ to a shocking and previously unheard of extent, basically openly demanding indictments of Democrats, regardless of reason or evidence, to help win elections -

give Jay Carney a break. I have no idea if he was or was not slow to pick up this story, but he's clearly come on board. Sooner is better than later, but later is better than nothing, and the commenters dedicated to insulting the editor would be better served to further detail the case against Gonzales and push back the inevitable dittohead spin, which has already appeared.

Criticize when neccesary, but know when to reward good behavior, such as is now being displayed. This is a neccesary element of good management. And management - of Time's coverage - is what we are, informally, exercising.

In other words, don't piss off people enough to make them irrationally hate the left. This is a problem already. Let's not make it worse. Only piss them off enough to get the job done.

Cranky Observer:

We should hold off until the comment ~12 above is investigated by the webmaster. Most blogs have a filter in place that prevents anon commentors from choosing a nym the same as one of the blog principals, but perhaps Swampland forgot to set that up and the referenced comment is a spoof.

Anonymous:

> In other words, don't piss off people

I don't have the exact words at hand, but I believe Mr. Carney (in a verified post) implied that Josh Marshall was a loony conspiracy theorist for pursuing this story, and has not apologized for that statement. Your comment might be appropriate if he had apologized, but that has not happened. Or are you saying the traditional media is free to criticize other reporters in the harshest terms, but that it itself should never be questioned?

Cranky

You say the White House IS central to asking slacker USA's to DO THEIR JOBS and investigate Dem ballot box stuffing in NM, AZ, WI, WA, TX, IL, MA...

Crandall S.:

I'm not surprised by Time not touching this; that's why I don't read Time - it's corporate hyper-superficial "journalism," far from real muckraking journalism. Typically, Time does the glossy post-story once every dirty detail has come out on blogs or "alternative" news sources (read: real muckraking journalists). I have never read Time to actually learn anything new. Please.

Thanks, Karen Tumulty. You're a good one.

Let me get this straight.

The slacker Clixon Regime changes EVERY sitting USA two months into their 1993 tenure (a big THANKS from Puerto Rican cop killers and Arky thugs to that one) - but it still IS not on the leftard gaydar.

However, when the GOP asks the DOJ to start acting on LEGIT cases of dem voter fraud (nationwide, and known) - all hell breaks loose at DNC HQ, er Time Ragazine, uh Pravda West?

Next non-news story please!

PS: Joe Wilson IS still a flaming oil-for-EU scam coward lefty draft dodging McGovernite liar, always was, always will be.
